This Indenture made this 17th day of August, One
Thousand Eight Hundred and Fifty Five.Between James Cook and his wife Martha
Cook, Walter E. Hatfield and wife Mary Hatfield, and Neil Breeding and wife
Rebecah Breeding, heirs of Andrew Hurst Decsd, all of the County of Claiborne
and State of Tennessee of the one part, and Levi Hurst, of the same County and
State afore said of the other part.Witnesseth that the said James Cook and wife
Walter E. Hatfield and wife Neil Breeding and wife for the consideration of
thirth dollars to them in hand paid,the receipt of which is hereby acknowledged
hath and by these present, doth hereby bargainand Sell to the said, Levi Hurst
his heirs and assigns forever all of our undivided interest in a certain tract
of land, containing fifty acres more or less lying in said County, in district
No.10, adjoiing the lands of Hugh Farmer's and others bounded, as follows to
wit, begining on ash and ellum near the water on the east side of a wet weather
branch above a very large cleft of rocks running north westwardly along a
marked line make by Plank and Hurst to a Suger (sic) tree in
the hollow leading to said Planks Barn, thence northwardly along a marked and conditional line crossing the hollow to a double dogwood thence northwardly along a marked and conditionaly up the South side of Comby ridge to a stake in said Planks line at or near the top of said ridge, thence Eastwardly with said line reverst (sic) to a Stake on the South side of Said Comby ridge thence Southwardly with said line revert, ten poles to Sycamore Creek near the old rock horse ford thence down Cinch river to the Begining, Excepting twelve feet wide on the bank of the river and Creek,for a road, to have and hold the same to the said Levi Hurst his heirs and Assigns for ever, and futher bind our Selfs and our heirs for ever, to defend the title to said land from all persond claimging through or under us.
